How to I protect my sons artwork from being used without permission?
My son is a great artist, he has been asked to put together some designs for skateboards. He’s young and easily manipulated. Can you patent or something artwork?
If this is a job, he’s giving the rights of his work to his employers unless stated otherwise in a written agreement. Prices should be negotiated up front. Will he get paid a lump sum for all his drawings , paid per piece they decide to use, or if he’s using their facilities per hour?.
If he’s getting paid a lump for the lot, all the drawings belong to the employer, they can manipulate them however they see fit, and put them on what ever merchandise they want.
If He’s getting paid per approved piece he should bring all the pieces in a physical format, (paper, not digital) They choose the ones they want and he keeps the rest. Again they can do what they want with them.
If he’s working per hour, all the work is theirs unless you have a contract saying otherwise. Also It is possible for them to contract him to own all his work during his period of employment. Example- he draws a cartoon on a napkin at home while working there. 10 years later the cartoon is used for a feature film. – they have rights to that character and can sue him for the profit he makes off it.
If this is a one time thing, or just for kicks, I wouldn’t worry about it. If they want him to continue designing over a period of time then you need to negotiate a contract with them.
